Today, I've spoken to
Amex Reps regarding a charge I've agreed to but, will not transact until Oct 25. However, I feel that regarding the background of the transaction that I in good faith tried to get "availability" for 2 and, I assumed that the quote was for 2 transacted with Safarinow.com. Not a good thing to do at 1am, but, did because the quote/offer was to expire in 6 hours (which I would be asleep if I didn't transact). Upon my realizing that I hastily entered into the transaction without reading the terms and conditions properly...I was quoted for 1 person when I originally asked for 2. I mean what's the point of getting a quote for one when there isn't availability for 2 people? So, I could not have made that mistake. Again, upon realizing my mistake, I emailed Safarinow.com's agent and asked them to cancel my reservations within 6- 8 hours of the transaction. I proceeded to call AMEX and with the above explanation, treated me badly and cautioned me that I entered into an agreement with Safarinow.com.
California laws states as follows: Internet Sales (when order has not been filled) -- 30 day
cancellation period (B&P 17538(a)). Why doesn't AMEX adhere to this law and immediately cancels for me the customer who calls them within 12 hours instead LECTURES me that I entered into an agreement and will have to hear the merchants side of the story; YES, I made a mistake...but, NO VALUE was exchanged...!!!!! I can understannd if I let this lapse for more than 1 day; but, I got anxious because I did this when I was tired at 1 am thinking I was going to lose a good quote...but, to my disadvantage...I don't have the support of AMEX. As a longtime COSTCO member, I am launching a complaint regarding my mistreatment. AS HUGE as AMEX is they should use better judgement on helping their Costco Amex members. This is a travesty in that clearly the merchant (Safarinow.com) is slanting the cancellation policies in their favor and there is "NO Cooling OFF" period. I realize that AMEX cannot control the merchant universe but, when they see that this cancellation policy is like stealing money....they/Amex should immediately not even wait for a response from the merchant. They/Amex should have a good faith cancellation policy that refunds 100% of the deposit within 3 days...especially within 24 hours. Of course, I don't have proof that I entered for 2 people; however; I have a standing reservation directly with another Safari operator who didn't even ask for my credit card and it's $800 cheaper. Indeed my mistake, but I'm trying to correct it without being penalize a penny...I've been penalized enough that it's consumed my time trying to CORRECT this. Also, that Costco should be aware and be sympathetic that this is an outrageous practice that AMEX is engaged in. I should open a website and see how many "HARRIED" people such as myself signs up/agrees to having $$$ immediately charged for no value received. Because this is Safarinow.com's practice I don't want to do business with anyone who does business with them...unfortunately, for me same with AMEX. I'm considering NOT ever USING my AMEX card EVER and not contributing to stimulating the world's economy if a mistake such as mine is not taken seriously and
policies are improved to protect consumers. I hope that Costco's customer and legal service will look into this matter and help to improve internet transactions. 1286875
